Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the website at www.rohrmanbodyshop.com (the "Site"), including the Spanish-language version at www.rohrmanbodyshop.com/es/, and any related online tools we provide. Bob Rohrman Collision Repair Center ("we," "us," or "our") operates the Site from 3400 National Drive, Lafayette, IN 47905.

By accessing or using the Site, you ("you" or "user") agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

These Terms apply to your use of the Site only. If you bring a vehicle to our shop for repair, the terms of the separate written repair authorization and warranty agreement you sign at intake control the actual repair relationship. In any conflict between these Site Terms and a signed repair authorization, the repair authorization controls for the in-shop services it covers.

2. Eligibility and Authorized Use

You may use the Site if you are at least 13 years old and capable of forming a binding contract under Indiana law. If you are under 18, you should use the Site only with the involvement of a parent or guardian. By using the Site you represent that you meet these requirements.

You may use the Site for lawful, personal, or business purposes that relate to obtaining auto body and collision repair information or services from us. You may not use the Site for any commercial purpose competitive with our business (such as scraping our content for a competing collision-repair website).

3. Acceptable Use

You agree not to do any of the following while using the Site:

• Violate any applicable law, regulation, or these Terms.
• Submit information that is false, misleading, or fraudulent (including impersonating another person, providing a fake VIN, or submitting a damage estimate request for a vehicle you don't have authority to repair).
• Attempt to interfere with, compromise, or circumvent the security or integrity of the Site, our servers, or our service providers' infrastructure (including Cloudflare's edge network).
• Use any automated means (bots, scrapers, harvesters) to extract content or data from the Site, except for legitimate search-engine and AI-assistant indexing as permitted by our robots.txt and llms.txt.
• Reverse-engineer, decompile, or attempt to discover the source code of any tool or widget on the Site.
• Upload or transmit viruses, malware, or any other code that could damage the Site or another user's device.
• Submit defamatory, obscene, threatening, or harassing content, including in messages, photos, or other materials.
• Submit content that infringes another party's intellectual property, privacy, or publicity rights.
• Use the Site to transmit unsolicited bulk email or other spam.
• Place a frame, mirror, or unauthorized link to the Site that misrepresents your relationship to us.

We reserve the right to investigate, suspend, or terminate access for any user we believe has violated these Terms, and to refer suspected criminal activity to law enforcement.

4. Intellectual Property

4a. Our content

All content on the Site — including text, photos, videos, graphics, logos, the "Bob Rohrman Collision Repair Center" name, the Rohrman Automotive Group logo, page layouts, and source code — is owned by us, our parent group, or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, revocable license to view and print Site content for your personal, non-commercial use, provided you do not remove or alter copyright, trademark, or other proprietary notices. Any other use — reproduction, modification, distribution, public display, or commercial use — requires our prior written permission.

4b. User-submitted content

If you submit photos, comments, or other content to the Site (for example, damage photos in an estimate request, a contact-form message, or a public review), you grant us a non-exclusive, royalty-free, worldwide license to use that content for the purpose of providing services to you, processing your repair, and demonstrating our work (e.g., before/after photos in a gallery, with personally identifying details obscured).

You represent that any content you submit is your own original work or that you have the rights to grant the license above. You retain ownership of your submitted content.

4c. Trademarks of others

Brand names mentioned on the Site — including vehicle manufacturer names (Honda, Toyota, Ford, etc.), insurance carrier names (State Farm, Allstate, etc.), and software platform names (I-CAR, Carwise, etc.) — are the trademarks of their respective owners. Mention of these brands does not imply endorsement of our services by those companies.

5. Reviews, Comments, and Feedback

If you submit a public review, testimonial, or other feedback about our services, you grant us the right to use that content (along with your first name and last initial) on the Site, in marketing materials, and on third-party platforms (Google, Carwise, etc.). You represent that the review is your honest opinion based on actual experience with us. You agree not to submit reviews that are deceptive, contain personal information about other people without their consent, or violate any applicable advertising or consumer-protection law.

6. Online Estimates, Bookings, and Services

6a. Estimates are not binding contracts

An online photo estimate generated through the Carwise widget on our Site is a preliminary estimate based on the photos and information you submit. It is not a binding price quote. The final repair cost depends on physical inspection of your vehicle, the repair procedures specified by the vehicle manufacturer, parts pricing at the time of repair, hidden damage discovered during disassembly (called "supplements"), and other factors. We reserve the right to revise the estimate after physical inspection and to require your authorization in writing before performing additional work.

6b. Appointment bookings

Appointments scheduled through the Carwise booking widget on our Site are confirmation requests. Your booking is not finalized until we confirm by email or phone within one business day. We may decline or reschedule appointments if our shop calendar is full, the requested service falls outside our scope of work, or for other operational reasons.

6c. Repair services governed separately

The actual repair services we perform on your vehicle are governed by a written repair authorization, the estimate you approve in writing, applicable insurance arrangements, and our written lifetime workmanship warranty. None of those are part of these Site Terms. Read every document at intake before signing.

7. Third-Party Widgets and Links

The Site embeds third-party tools (Carwise photo estimate and booking widgets, Trustindex Google reviews widget, Google Maps) and links to external sites. We do not control these third parties and are not responsible for the availability, content, accuracy, or privacy practices of third-party sites or services. Your use of those services is governed by their own terms and privacy policies.

8. Disclaimers and Warranties

Heads up — this section is in capital letters because federal and state law require disclaimer language to be conspicuous. The capital letters do not mean we are yelling at you; they mean these statements have legal weight. Plain-English summary follows below.

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATIONAL CONTENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

INFORMATION ON THE SITE ABOUT REPAIR PROCEDURES, REPAIR TIMELINES, COST RANGES, INSURANCE PROCESSES, AND INDIANA LAW IS PROVIDED FOR GENERAL EDUCATIONAL PURPOSES AND IS NOT LEGAL, INSURANCE, OR TECHNICAL ADVICE FOR YOUR SPECIFIC SITUATION. NO ATTORNEY-CLIENT RELATIONSHIP IS CREATED BY YOUR USE OF THE SITE OR BY ANY COMMUNICATION YOU SEND THROUGH IT.

In plain English: the website is provided as a public-information resource. We try hard to keep it accurate but we don't promise it will always be available, error-free, or applicable to your exact situation. The repair services we actually perform are warranted under the separate lifetime workmanship warranty you receive at intake — that warranty isn't affected by anything in this Terms section.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR PARENT COMPANY, OUR AFFILIATED ROHRMAN AUTOMOTIVE GROUP ENTITIES, OR ANY OF OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE.

IN ANY EVENT, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

What this section does not cover: the actual repair services we perform on your vehicle. Those are governed by the separate repair authorization and our lifetime workmanship warranty. The cap above applies only to issues arising from your use of the website itself (e.g., website downtime, website errors, third-party widget malfunctions). Some jurisdictions do not allow exclusion of incidental or consequential damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bob Rohrman Collision Repair Center, the Rohrman Automotive Group, and our respective officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of (i) your use or misuse of the Site, (ii) your violation of these Terms, (iii) your violation of any law or the rights of any third party, or (iv) any content you submit through the Site.

11. Changes to the Site or These Terms

We reserve the right to modify, suspend, or discontinue any part of the Site at any time, with or without notice. We may also update these Terms from time to time. When we update them, we will:

• Update the "Effective Date" and "Last Updated" at the top of this page.
• If the change is material, provide reasonable notice (e.g., a banner on the Site) at least 30 days before the change takes effect, where required by law.

Continued use of the Site after a Terms update means you accept the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. The federal Electronic Signatures in Global and National Commerce Act ("E-Sign") and Indiana's Uniform Electronic Transactions Act apply to your acceptance of these Terms.

Any dispute arising out of or relating to these Terms or your use of the Site that cannot be resolved informally will be submitted to the exclusive jurisdiction of the state and federal courts located in Tippecanoe County, Indiana. You and we both consent to personal jurisdiction in those courts. Either party may seek injunctive relief in any court of competent jurisdiction without first attempting informal resolution.

13. Informal Dispute Resolution

If a dispute arises between you and us about your use of the Site, please contact us first at [email protected] or (765) 448-1100. We will work in good faith to resolve the issue. Most disputes are resolved this way without legal action. We require at least 30 days of informal resolution effort before either party files a lawsuit, except that either party may seek immediate injunctive relief in court without waiting.

14. Electronic Communications

By using the Site or providing your email address or phone number, you consent to receive electronic communications from us related to your use of the Site or services you have requested. You agree that any notice, agreement, disclosure, or other communication we send electronically satisfies any legal requirement that the communication be in writing.

15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written repair authorization signed at intake, constitute the entire agreement between you and us with respect to your use of the Site. If you bring a vehicle in for repair, the written repair authorization controls the in-shop services for which it was signed.
